iPhone stolen, never activated in store

So sad long story, on Wednesday I went and switched from Verizon to Att and purchased iPhone 15 pro max 256. The store was busy rep asked if I needed assistance adding my iCloud (I said no as it’s my like 12TH iPhone) so he gave me the phone NIB and I walked out, went to the fast station not even 3 minutes inside good, came out phone was gone. 

called rep where I had just left he directed me to file a claim. Did so it was denied. Called rep back he said try again it should be approved! Did so denied again and this time Asurion said Att can and will help it’s on them. Relayed the message he said no call them back, did so this time they had me do an affidavit and submit. Did so came back denied this time for usage on device after reporting stolen. 

nobody wants to take the L here. What do I do?

I just read a sample Asurion contract, and it looks to me like they do disclose that the phone has to be activated to be covered. If that’s the deal you agreed to, you are out of luck.

Quick facts:

• I assumed it was activated. It was not which is why the first claim was denied Asurion says.

•the rep should have activated the phone before I left the store. I just thought all I had to do was the whole transfer my iCloud over

• I assumed rep reported stolen as I came and reported to him (he did not)

• when I told him about the 3rd denial (for usage) he was like well duh people are using it

It has to be activated with your AT&T phone number and have to have paid for insurance, in order to be covered by insurance.  

No?  

Could not be more of a cautionary tale.

Service providers require your service has to be active and you have to have insurance active on your account. If none of that was processed before you left the store with your phone, you were not covered.

Apple Care Plus with loss and theft is only active if your iCloud and find my phone are on. If find my phone is not on they will not cover loss or theft.

And last ... Never, ever leave anything of value in your car. Not your purse,  camera,  phone, nothing of value,  ever.  Not even for 5 minutes. You put it in your pocket you take it on your person in hand whatever.  Thieves are everywhere and they are far more observant than the average mark 

This is an expensive lesson.

I did have insurance. Again, I was at the store with a representative. I assumed after 2 hours of being there all this stuff was complete. I was under the impression all I had to do was transfer my photos/ect to the new phone. 

it was on my account and everything, I just didn’t get a chance to make a call or anything and that was their quarrel. 

yes I was just in a hurry and it was literally less than 4 minutes and they have tints but close up you can see straight through. Im at fault somewhat for that (somewhat because it’s my phone in my car on my seat. NOBODY had the right to remove it, no matter what. 

however, the rep is at fault. I wasn’t supposed to leave out the store without an “Activated” phone according to their policy. It was supposed to be opened and inspected. I hate to do it but I have to complain about him, had he not been in a rush to get the next customer, and opened up the phone to inspect ect. Then I would be able to successfully claim. He is still telling me “Asurion will do it, keep trying” idk I’m headed into the store to talk to the supervisor tomorrow.

If service was active, and so was your insurance I think you're covered.  But what I think does not matter.  What is Asurion policy on cellular activation versus iCloud activation. I did not think it mattered with AT&T insurance

It would make a difference with AppleCare Plus

What was done to the phone before you left the store?  Turned on?  Set up?  In my experience with iPhones, you turn it on and go through initial setup, including signing into iCloud with your ID before activating the SIM.  I’ve never had a iphone come with an active SIM.  Always had to activate it during setup.   Did all of that happen, or you just got the sealed box and left?

He did something online, ported my number over and said I was good, did not open the box and it has a E-sim, the 15’s don’t have physical sims anymore

If it was never turned on or setup, it wasn’t activated.  All he did was program the eSIM with your number.  Thats not the same as activating the SIM.  Not even sure it’s possible for them to remote activate the SIM in the store with the phone off.  

I suspect their position is going to be that you said no to having them help you set it up (which includes activating the SIM as part of the setup process), so that meant you wanted to do it later, on your own.  Good Luck.
