My plan includes Max, but I can’t seem to file the activate max tab on my account page.

@Fmaxie Max is now deciding who has access to Max thru an AT&T account. It could be due to the fact that AT&T spun off HBO Max months ago and the new company rebranded it as Max. Discussions about this have been going on for over 6 months now and the sunset date was Dec. 5th. You can try to see if AT&T Support can work with Max but ultimately it will be up to Max to decide if you get free access or not. Those that were able to get their accounts migrated to Max were downgraded to the full HD tier. If you want the 4k HDR/Atmos tier you will have to subscribe to Max and pay for it.
Your TOS states that services are subject to change so now that Max is its own company, that's a change.
