Manufacturers malfunction?

To whome it may concern, my iPhone XS Max seems to act weird sometimes. When videos are being played the phone acts like I’m touching the screen sometimes even if I set the phone down. It also doesn’t seem to have the charging port problem fixed even with the update. It also freezes in the middle of apps sometimes. The phone is in perfect condition. Can I send it back and get another one? Thank you.
