You could also try eBay if you feel comfortable with that. You could even get the same type of phone if you really wanted to. Good luck in finding a device that best suites your needs.

I would do some troublshooting with att until your contract is up. At least troubleshooting is free, but you will need some time on your hands... Att will only waive the fee if it seems appropriate such as a death in the family. A network/device issue would not be one being as service is not guaranteed everwhere.

If you call in to att they also might be able to tell you when the account was created. I've encountered this question with some customers and it's not that difficult to find out on att's end.

I would contact att customer support for this issue. Make sure you are actually paying for the data plan because it could be that it is not provisioned on your account.

For the blackberry a data plan is required with att on all models of blackberry locked/unlocked. However, the tmobile sidekick unlocked may not require a data plan bc att may not support the data plan for it, so it probably will not be required.

The moment you call att and confirm that the account holder has passed away, att will put a note on the account regarding a transfer of billing responsibility needing to be in place or they would cancel the account (just giving a heads up). You will have to do a transfer of billing responsibility if you want the account the be in your name.

On you bank statement it should show what account it took from. Do you have any other att services? Do you have an iPad?

As long as the frequencies work and it works with att (of course, duh lol) it will work. You can still keep your data plan as stated above as long as you have a smartphone.
