The iPhone manufacturer (Apple) requires that all warranty work be performed by Apple themselves, or partners they have certified as Support Providers (ASP). Remember that as of very early this year, AT&T did away with teh contract subsidized phone discounts. That means that you will be paying full price for a phone, or getting in on another one of the promotions like the Buy One/Get One (assuming you meet their strict requirements). Other than teh promotions, there are no "discounted phones" for signing up for new service.

You would need to call AT&T to get an official response, but it sounds to me like the repairs are taking longer than expected. That happens from time to time, especially if they get into a cable cut that turns out to be multiple cuts that weren't originally expected.

If you want to return the phone under the "buyer's remorse" period of 14 days, then you can return it to AT&T. If you have a warranty issue on your new phone, then you would need to deal with Apple (their rules). Changes (this year I think) allow them to choose either of the options you ask about. The newer changes allow them to transfer the NEXT Agreement to the new account with the new line, but they can still choose to pay off the entire NEXT Agreement when the transfer is performed. It really comes down to their credit rating as determined by AT&T and what option they prefer.
