I thought "smartphone" in AT&T-lingo was any device with a wi-fi adapter inside it. For example, the Samsung Impression has the slider keyboard, touch screen, and 3 megapixel camera, but doesn't have a wi-fi adapter [or Windows Mobile], so AT&T doesn't call it a smartphone. I visited a different AT&T store yesterday (Saturday, April 24, 2010) in Ohio this time. To date, the ruling is that any smartphone used (be it activated with a contract or just had a SIM-card inserted) prior to September 6, 2009 would not be charged the $30/month data fee.
