So what can I do if I sent my window phone back, and they sent me a different one but this one gets hot all the time, and at times you tap to see things you have to tap it a couple of times and harder then before what can I do if this is a replacement phone
You can send that one back to get it fixed or replaced - the one year warranty is still in effect, and that is not normal.

Contact Nokia directly. Your initial purchase comes with a 1 year warranty. Your phone is not functioning correctly.
You can view the warranty here http://download.fds-ncom.nokia.com/supportFiles/phones/files/pdf_guides/other/WARRANTY-CA-US_en-US.p...
You can always try going through AT&T for warranty service, if you wish - if so, do whatever you did the last time you exchanged the phone.
