You can switch your SIM card from the old phone to the iPhone 3GS.  Then call AT&T, have them update your IMEI in their system, and select a data plan.  Data plans are required to use a smartphone on AT&T.

There is no cost to switch phones and no changes to the contract. The only additional cost is the required data plan.

Check out your pricing here: http://www.wireless.att.com/cell-phone-service/cell-phones/pda-phones-smartphones.jsp

You will not qualify for the discounted price but you may be eligible for the early upgrade price that runs $200 to $250 more than the price of the discounted phone.

AT&T doesn't charge you anything extra if you bring your own phone. You just pay the monthly charges.
