Trying to buy a new phone to replace a stolen phone on my plan

Hi, my iphone 3G was recently stolen. I want to replace the stolen phone by buying myself an iphone 4 with my upgrade that is available. If I do this, will I have to sign a new 2 year contract with at&t even though it's an upgrade for a stolen phone, when I will not be changing anything about my current unlimited plan package? If I do have to get the 2 year contract, is there any way to avoid it besides getting a different phone?

The one and only reason you would ever want to sign a 2 year contract is if you want a discount on a new phone, with the 2 year contract iPhone 4 will cost you $199 for 16GB or $299 for 32GB. You can buy one without signing a contract, it'll be just $649 for 16GB or only $749 for 32GBSmiley Wink
