Spouse's phone can be upgraded, but can I swap to use it?

My spouse's 3gs (2 gig data plan) is eligible for an upgrade. I have the iphone 4 (unlimited data plan), not eligible. I would like to upgrade the 3gs to the 4s, and then swap the phones around to be able to use the 4s myself. Will there be any issues with doing this? Especially concerning the data plans? Thanks.

iPhone 3G/3GS/4/4S all use the same data plans (you can keep your existing one)

 

I would just upgrade her line to 4S and then a few days later just back up your phones in iTunes (saves your contact list, messages, phone settings) and then just switch out the SIM cards and restore the phone backup that you did so that your iTunes backup is on the 4S and hers is on the 4 (so backup both phones then just switch the SIM cards then restore the settings to each others phone)

 

AT&T wont care since both are iPhones and both lines have iPhone data plans
