I received this email from a rep today...it was added back on...

Dear Telia {Personal content removed for your safety},
Thank you for contacting AT&T about your wireless service. My name is Howard {Personal content removed for safety} and I understand it is frustrating to have your unlimited plan removed and have a data plan added to the wrong line. I am more than happy to assist you today with your inquiry regarding the data plans.
I called and left a voicemail on your line. I will receive your reply to this email. I escalated your issue, stating your value as a customer and how long you have been with us and that you were given misinformation at the point of sale. As a result, management agreed to make an exception and the $30 iPhone Unlimited Data package has been added to the **** line effective immediately. You will see a prorated (partial) charge for the previous package and a prorated charge for the new package before the discount on your next statement. Please make sure your Visual Voicemail and data are still functioning correctly. I apologize for the frustration this situation has caused.
Telia, if you have any additional questions about your data plan, please respond to this email. If you have a question about another issue, please send us a new email via the Contact Us link in the lower left-hand corner of your myAT&T account. Thank you for choosing AT&T; we appreciate your business.

What were you trying to do when they "made you change", anything? Or were you just there using your grandfathered phones when out of the blue ATT called you up and said you had to change plans?

my iphone 3gs was damaged by water, so i used an old backup phone and kept the unlimited plan as i was going to upgrade when it was time in a month.  i upgraded to an HTC Aria, which ended up going back.  I then received an iPhone 4, in which i was told that i cannot have the unlimited data plan, even though i had another iPhone 3gs with my current family plan with unlimited data, they still would not allow me to have it.

2 months ago, my husband upgraded from the iPhone 4 to a blackberry torch and they would not allow him to do the unlimited plan.

therefore, because of this, i have gone over data quite a few times, but not by much, and i still get charged for each line that goes over by $10 each.  i have fought and fought with at&t on this, and have been told that nothing can be done about it that its already changed and whats done is done.

The grandfathered iPhone $30 unlimited data plan was exactly that - grandfathered as long as you remain on an iPhone.

You describe two lines where you had this plan, and then switched to a non-iPhone for an extended period of time. At that time, the plan became unavailable for that line.

You should be on the 2GB plan, which costs $5 less a month. If you go over every other month, you're breaking even vs the old $30 plan.

If you're on the 200MB plan, obviosuly you should consider going to the 2GB plan.

switched from the iphone to a windows 7 phone, grandfathered plan stayed, switched back to the iphone and plan still stayed. The unlimted plan stays as long as you upgrade between smartphones, no matter what one it is

Yeah, that's what I'm thinking. Type of smartphone shouldn't matter?

Yeah, type of smartphone shouldn't matter. But the problem is some people think their phone is a smartphone, when it isn't.

I don't get why it should matter whether or not he continuously used a 'smart phone' or not.  As I currently understand it, the OP kept their contract current and never asked to shut off the unlimmited data, constantly paying the 30/month fee each billing period.

So what if he temporarily switched from a 'smart phone' to an old Motorolla brick phone, so long as they kept their plan.  All that could possibly be different is that for the period the OP isn't using a 'smart phone', they are incapable of fully utilizing the full potential of the data plan they're paying for.

Why AT&T should CANCEL the unlimmited plan when the OP finally gets back to using a smart phone is really beyond me.  Did AT&T, at the very least, credit the OP's account for the unlimmited plan charges while the OP was not capable of utilizing it?

I think we know the answer to that...

What I'm not getting is how or why the op could have been on a data plan and paying data plan charges while not using a phone that requires it. I could see the argument that the type of smartphone shouldn't make a difference. But if there was no longer a data enabled plan -- for whatever the time period -- that would support the cancellation of the grandfathered situation.

I don't agree with that.

If I need to temporarily switch to a non-smart phone, as long as I continue paying for the 'temporarily' superfluous unlimmited data plan, I should be allowed to keep it, and later activate a new smart phone that will fully utilize the plan.

Correct me if I'm wrong, but when I reviewed the TOS and my contract with AT&T NOTHING I've ever read seems to indicate that if I DO NOT use data, AT&T has the right to irreversably revoke my unlimmited data plan.

It'd be along the same lines as me turning my phone off for a few months...  As long as I continue paying my bill each month, when I finally DO decide to turn my phone back on, ALL THE SERVICES I HAD BEEN PAYING FOR UP TO THAT POINT SHOULD BE THERE...
