Can I swap gateway modem if I buy one myself?

My current modem is a 3801HGV and it has been getting really hot and was wondering if I bought the AT&T U-verse Pace 5268AC can I unhook the old one and plug the new one in without any issues

No.  Att needs to supply it.  Doesn't matter if it's also one of the models att uses.  The 3801 is old.  I don't think att even want's them returned any more when you replace it.  Call and ask for the replacement and confirm whether they do or do not want it back.

Thank You for the response I will call them because it feels like I have been having overheating issues with it and intermittent internet drop off when it gets hot and the modem has plenty or airflow getting to it.   So again Thank You for the quick reply
