Upgrade packaging kit never sent despite three requests

My son and I have requested the upgrade packaging kit 3 times since September and were given assurances and a reset of the upgrade time period, but still haven't received a kit. It certainly seems like an ATT strategy to delay the upgrade amount until we give up. I see others with this issue online. Will it take a (Edited per community guidelines) suit to get our upgrade $?

Have you verified the billing address they have for you is correct and that they are sending to a valid address?Otherwise, you can escalate to corporate by filing an FCC or BBB complaint.

We did verify the address the last time we called and are giving it another week or so since it is a busy mail season. After that your suggestion sounds good.
