Phone upgrade

I ordered an iPhone 12 pro, received it and found it was not quite what I wanted. I returned it in the box it came in the day after I received it. I wanted to, instead, upgrade to the iPhone 12 max but I have found a roadblock to doing this. Apparently the device I returned has not been received by the warehouse as of yet and until they do, I am being told that I cannot complete the upgrade transaction. I originally sent the device back on November 12th. This is quite frustrating and I would like to find out what I can do in order to upgrade to the iPhone max. Any help would be appreciated.
