ATT Next Confusion

Hey I’m having trouble with att next. They have my phone and they will not return it to me and they are charging me for not ever returning my phone.  They said because it wasn’t late. So they are charging me and they said they cannot give phone back. I’m legit being scammed. Not sure what to do. Hope to hear from you thanks.
