Being charged for "free" HBO for life
I was told I would be getting HBO free for life, but now being charged $39.99. I keep having to call and get this charge removed, which takes hours. Why?

Was it a promo? What did the TOS indicate?

TOS were HBO for life - for having both ATT and Direct TV - promo for having both and for consolidating bill. Free HBO for life to me means getting HBO free for life - but I had to fight this once before and it was a mess. If I can get through to DirectTV I'm just going to cancel - not worth it any more.

What promo? Here's an article on how to get HBO Max included with other services, such as Internet 1000 or DirecTV.
HBO Max costs nowhere near $40.

Even if not free, HBO doesn’t cost $39.99. You sure that charge is for HBO?

Who "sold" you the HBO Max free for life package? Was it online thru AT&T, an AT&T Corporate Store, of an Authorized AT&T Reseller. $40 sounds suspicious as mentioned.
