Fraudulent activity

Hello!  My name is Madeline McIntosh.  I have an account with my husband Kurt Anderson.  I have recently been getting emails regarding another account with a past due bill.  When I called AT&T they say the other account has my information on it, but with another person's name I do not know.  I asked them to take my information off that account as it is fraudulent and not me.  The Tech stated he couldn't take my info off, and that only the person whose name is on the account can take off my info.  Is there nothing I can do other than hope these fraudulent charges don't come back on me?  Seems pretty shady of AT&T to not protect their customers.
