Easement through backyard where we plan on building a patio

There is a 30ft wide AT&T easement running through my backyard, at an angle, and somewhat close to the existing deck.  We have a designed patio that encroaches into the easement.  There is a lot more room on the property and want to inquire about permission or a variance to build into this easement.  What are the proper steps to have this inspected and applied for?
