It may be better for you anyway. If it was reported lost/stolen, and you have it in your posession, most states would consider that posession of stolen property, which could entail jail time if it is linked to you...

You can return it to a corporate AT&T store and they will be happy to try to return it to the previous owner and if they can't, they'll recycle it responsibly.

nope because the simcard is dead already and the phone is already reseted, just want to know if this phone is still usable or just a dummy phone now

Usually if a phone is lost, the owner reports it to AT&T and the phone is blacklisted. Once it is blacklisted, it is unusable as a phone.
