With any phone on a 2 year contract, you were offered the phone at the subsidized price. If you had continued service till the end of the 2 year contract, AT&T would have recovered the cost of the subsidy. Because of early contract termination, AT&T is asking you to pay $325 ETF to recover the cost of subsidy. The ETF is in the contract that you signed when you signed up for service. With other carriers, you would pay an ETF too. AT&T is no different.
You are paying for the phone that you never paid full price for. You can then sell the phone to recover the ETF that you have to pay AT&T.
