Phone no longer works and AT&T no longer carries it....

Ok...a little back story...
I got a HTC Freestyle in the begining of 2012 and had MANY problems straight away. After 20 days, I got frustrated of the multiple Oops...an error has occured messages that happened everyday, the overheating, freezing and slowness so i went to a device service center. I asked if it was possible to replace the phone with a different model and they said no (i had read the reviews :\) so i get a replacement. Getting replacements became almost a monthly thing! Ive had between 5/6 replacements since ive had this phone
Last August(2012), i went in to get my 5/6 replacement but! EVERY SINGLE HTC FREESTLYE in the store was DEFECTED so they mailed me a replacement. This last replacement was wonderful with only the occasional Oops...an error has occured messages until today. I used my phone at about 12 pm and then went to work and at 5, came back to a phone that is stuck at the HTC screen.
I went to device support center today and found out that they no longer carry the HTC Freestyle and can do nothing for me and that I have to file an insurance claim. Honestly I was extremely annoyed but i went home and began to file the claim.
It turns out that the phone they would replace my phone with is JUST as UNRELIABLE and on top of that I'd have to pay a $50 deductable just because AT&T no longer carries my phone. (I honestly would not be mad about this if the offered replacement was reliable)
So my question is...
Do i have any other options?
Will customer service beable to help me? or am i stuck paying the $50?
