The OP said he got the iPhone when it first came out in 2010, which would have been late June 2010. That's over 2 years ago. I don't see that suggesting that this has something to do with a final bill or pro-rated charges has anything to do with the OPs situation. He didn't ETF out of his contract.
if he had not paid the final bill when he upgrade and was still on the same billing cycle it can be determine that the phone is not off contract - when I state the "final bill" is has nothing to do with terminating the service. If your billing cycle ens on 10/25 and you upgrade on 10/1 the commiment is not up till you pay the bill for the cycle that ends on 10/25 - that has been from personal expierence
