File a complaint with eBay and get 100% of your money back. This is a scam by the seller and they should pay. Even after the seller fullfils their contract in 2 years, you would not be able to unlock your iPhone as you are not the buyer from an official retailer.
Absolutely do this. You have a good chance of getting your money back.
Also, don't buy newly-released iPhones on eBay and if you do, be certain they are FACTORY UNLOCKED. They may not be available in the US yet, but they are available in other countries.
