2 years really isn't the criteria. If you are a current/former AT&T customer, your contract (if any) on the phone has to be satisfied. That can be less than 2 years. If you aren't an AT&T customer and never had a contract, there is no time criteria. You only had to buy the phone at the no commitment price from an authorized retailer.
