If I get a new smartphone and still in 2-year contract, does the data plan still work on it?

Hello, people! I accidentally broke my new smart phone 2 week ago and I'm thinking about getting a new one (unlocked or from AT&T), but I'm not sure if the new phone works on AT&T's wireless plan (which I pay $20 every month), or I have to be charged for early termination fee. Does anyone know about this or anything similar has happened to you before? Thanks for telling me about your story/opinion/thoughts!

You can buy one at full contract price, or from another source (such as ebay or craigslist) and simply replace your broken phone and continue on your current contract. Just be sure it uses the at&t frequencies.
