Actually a upgrade does not mean a new contract, a upgrade is going from 1 phone to another that is purchased new (or used, but new to you in general), whether or not a discount is taken is whether or not the phone is discounted from the original sale price from a sales outlet that is a authorized AT&T dealership.

I don't know if its "new customer" pricing per se, but yes, if you are out of contract, typically you are eligible for a discounted phone. Generally, its if you are 90 days prior to expiration of your contract that makes you eligible.
In my experience, upgrading through your Online Account Manager (OLAM) gives the best pricing options on phones, vs going into the stores.
