You know what, I am a ATT customer since 2003 and now after 10years I say it loud and clear, I HATE YOU ATT. I hate your service, hate your business policy and your {word filter evasion} dataplan. You have no rights to add data plan to my account and if you think you have the rights then listen and remember AS A CUSTOMER I HAVE THE RIGHTS TO SWITCH, Do you hear me??? Just CHANGE THE SERVICE. As simple as that. And I am happy to tell you that I am ditching you for VERIZON. Goodbye.

Good luck with Verizon. They'll require a data plan also if you have a smartphone.

What data plan does Verizon offer that AT&T doesn't or better than AT&T's? All major carriers require a data plan on smartphones.

The Terms & Conditions that you signed up for do state that if you have a smartphone, AT&T can and will add a data plan.
Wireless Customer Agreement / Terms & Conditions -
A voice plan is required on all voice-capable Devices, unless specifically noted otherwise in the terms governing your plan. An eligible tiered pricing data plan is required for certain Devices, including iPhones and other designated Smartphones. Eligible voice and tiered pricing data plans cover voice and data usage in the U.S. and do not cover International voice and data usage and charges. If it is determined that you are using a voice-capable Device without a voice plan, or that you are using an iPhone or designated Smartphone without an eligible voice and tiered data plan, AT&T reserves the right to switch you to the required plan or plans and bill you the appropriate monthly fees. In the case of the tiered data plan, you will be placed on the data plan which provides you with the greatest monthly data usage allowance. If you determine that you do not require that much data usage in a month, you may request a lower data tier at a lower monthly recurring fee.
If you don't want a data plan, it's simple: get a non smartphone. Either by purchasing one outright, using your upgrade or get a cheap gophone and use it on your account. ![]()

You could use GoPhone prepaid, no data plan enforced. You can also use the phones you have now.

Verizon DOES allow voice and data at the same time as lomg as its LTE data.

99 percent of the phones that verizon sells does not support SVDO which is what is required for this capabability - not even tthe iphone 5

OP, just remember when you switch to Verizon, your only choice for post paid service will be one of their share everything plans. In other words, you will be buying data whether you want it or not and it won't matter whether you have a smartphone or not.

If a Verizon Wireless customer only has a basic phone, there is a Share Everything plan that doesn't include data. But for the OP's point, if he/she will use a smartphone on VZW, a data plan is required.
