1. Yes if you cancel within 3 days by returning your phone to the place of purchase. After 3 days but before 30 you can cancel and not be subject to an ETF.

2. No you cannot keep it. They will charge you a 10% restocking fee. - Well publicized.

AT&T's return policy has changed effective 10/07/12. You have 14 days to return the device & cxl without a ETF. Policy info HERE.

The $175 that the rep is referring to is the Early Termination Fee. If you are within the buyers remorse period, then you wouldnt be charged an etf, but you will be charged full retail price of the phone, should you decide to cancel service and not return the phone.

The OP didn't lose the iPhone, it was a "what-if" scenario to try and keep the phone without paying full retail.
