They are doing exactly what you agreed to let them do, the only issue is you put your singature either electronicly or physically under the line that states "I have read and understand this agreement" when you did neither.

OK, you might not work directly for AT&T, i will call you a consultant then...I guess it doesn't really matter what company you work for, point is, you clearly come to the forum to support/defend AT&T actions with your 5,000+ posts on an AT&T forum...hmmm!
Listen, I work for a large corporation also, I get it....AT&T looks at data like peak and non peak when cell plans first came out, opportunity to make more $$$ You say that I agreed to it....well...I agreed to unlimited data, the unlimited data I got for 2 years at the same download speed from the first day of the month to the last day of the month! I know the pencil pushers at corporate ran 100's of spread sheets and they know they will lose some customers because of this and they think it's fine because they will gain it back in the extra $15 per month they will get when they convert the unlimited people to the $45 plan. Whatever I signed on the agreement is irrelevant! It's a DIRTY BAIT AND SWITCH SCHEME!

not a consultant either for them either, about 15 or 20 years ago yes we did do some work for them in the POTS line systems but nothing since, we don;t run in the same business circles anymore, branched out to a lot more lucrative contracts then dealing with wireless carriers.
As far as the number of posts, per average age of account have alot less them some of the recent people. There are some people that have been members for a couple of days and already have over 100 posts. If you reguallry read the other carriers forus you wil see that I am there also. If I have some down time I usually read the forums for relaxation
Sorry, the idea of "bait and switch" is just your opinion, if you have reviewed the terms that you actually agreed to then there is no "bat and switch", they and other carriers are enforcing polices that have been in affect since the unlimit data plan was introduced years before the Iphone was even a idea on the engineers drawing boards. Might want to review the definition of what you claim als.

Even though we don't agree with what they are saying..at least the "Community Leaders" keep bumping this thread up to keep it at the top so everyone can see....It would probably have faded away had they not kept responding.

Thanks for giving me a little background about who you are! I'm not trying to attack you but if you would step back and look at it as a consumer and not as a business for a second, you might be able to understand where the consumers are coming from. I'm sure if your business were to enter into an agreement with another company, you would have your lawyer review the contract and negotiate the terms. The average consumer doesn't have a lawyer review the contract and translate the usual double talk in contracts.
I'm sorry but if you have been a business partner of AT&T in the lst 5 or even 10 years, you may not think you are but you are giving a biased opinion.
Just for the heck of it, i looked up the definition,
Bait-and-switch is a form of fraud, most commonly used in retail sales (wireless services provided by AT&T)but also applicable to other contexts. First, customers are "baited" by advertising (Unlimited data $30.00 per month)for a product or service at a low price; second, the customers discover that the advertised good is not available and are "switched" to a costlier product (AT&T summer of 2011 decides to throttle top 5% of data customers....UNLESS...they SWITCH!!! to the $45 4 GB plan and then their speed won't be affected.
That's exactly the definition I claim!

no, would only disagree with that if they where actually violating something, have had my disagreements with a form of att going back to the time that you counted the number og rings to decide if the call was for you.
In this case I have absolutely no problem with with what they are doing, the policies have been in place since day one and they where agreed to when the agreements where signed either physically or electronicly. So no it is NOT the exact definition of what you stated, you agreed to it, either knowlngly by actually reading all the documents that you signed or by just signing under the line that states you have read and understood the policy. No "bait and switch" here sorry to disappoint you.
No, you can switch to the 15.00 200MB plan or the 2GB 25.00 plan to avoid the throttling of the grand fathered unlimited plan, the only main difference is you pay for the overages rather then continuing to get your unlimited data at the same price at a reduce throughput. Get restrained by reduced throughput or by getting hit on the bill at the end of the cycle, your chcoise and the personal responsiblity of manging your data habits.
The one thing that I do disagree with is the method that was used, it should have been done exactly like the removal of the no data plan required for a smartphone exemption, not "grand fathered" or "tiered"

thay have to do something to get some of the market share. Would be interested in seeing the links to what you claim is there, must be missing it since it is not to be found, but then again we may have different meanings to "slams" when it comes to businesses, the "slammed" businesses tend to take offense at quickly move to have the "slam" taken down.

You can keep saying that I signed the agreement a thousand times but that doesn't get rid of the fact that AT&T never once put a disclaimer on any of their advertisements about the $30 data plan, I have copies of the brochures. Not once do I see a mention of use of data just that it's unlimited. What I signed up for was an unlimited plan and I got one for 2 years, I was told I could keep my unlimited plan and I did, I DIDN'T agree to throttling! AT&T could have told all of it's loyal customers screw all of you, no more unlimited...instead, they are sneeky about it and try to pick off people one by one, if you think about it...the top 5%, if we start off with a million on unlimited and the top 5% get fed up and leave or switch to a tiered plan, well, it will eventually get to a point where a person who uses 500 mb could be in the top 5%....makes you say HMMMM????
Its sad that AT&T had to find a loop hole in its agreement with its customer to strong arm people to swith to a program that is more expensive.

sky rocket, everyone who is affected by this scam needs to band together! I was thinking that we all just leave our phones plugged in streaming music as much as possible, yes it will be slow but it will be drawing from the network! I've never seen a situation like this in my entire life....usually they want to make the customers happy...instead they would rather have you cancel!

why exactly is a disclaimer needed when you signed a document that you did not read. The terms where there you just did not read them. Actually you did agree to the fup, but you didn;t read and understand what you signed.
Pray tell how exactly can someone you utilized 500mb be consider in the top 5%? especially since the top 5% is reset every billing cycle? Makes me say something but definately not what you think. No loop hole needed.

disclaimers are put in place so consumers don't fall pray to bait and switch tactics like this!
It's pretty simple math, if AT&T gets the top 5% to switch monthly, the unlimited pool continues to shrink...they get 95-100 to switch this month, then 90-95 is in the top 5 next month, month after that 85-90 is in top 5%etc etc....come on, that's why they made it a percentage not a data number...they want everyone to switch to the tiered plan.
I did the math,if there are 1million unlimited data users and AT&T gets 5% per month to switch to their tiered plan every month, by month 14 the pool of users will be cut in half and the people who were in the 50th percentile will now will be in the top 5%...each month people will call to complain and the line will be...well, you are in the top 5% of all data users, you need to upgrade and your data speeds won't be affected in the future..its slick I admit just sleezy!

I hit 23gb last month after getting throttle, I just keep the phone running BT 24/7. Going to drive up the 'average'.

or run afoul of the AUP and find yourself in another situation

This is what i'm doing too...as well as boatload of people on another forum. I noticed I didn't get throttled til almost twice the usage this month..so its working. One of the guys on the forum got 39 gigs and is trying to get them to terminate his contract..then he can go to VZ, without the ETF...lol

and having AT&T advertise unlimited plan throttle to the point of not useable makes even more sense amiright?

Have a question for you - have you thought this through - suspect that if they enforce the AUP and terminate you with no etf you will wake up one morning and your phone will have "no Service", depending on how many people have your current cell number you could be scrambling for awhile getting your new number out to all contacts points. Can;t port a canceled account;s number
Sprint is the last remaining tier 1 - 3 carrier that has a "unlimited data" tempered by the TOS and FUP, so you might want to move fast and port your number, the 5th estate has already reported that Sprint may remove the unlimited data for the new cellular technology.

We all have a bad taste in our mouths because of this backdoor tactic to get people to switch to the tiered plans. if you make a lot of your customers unhappy, they will go to extremes to make a point. I don't blame anyone for letting their phones run all day and night to prove a point. I for one never abused my data plan, I have a wi-fi network at home and would only used 3G on the road as I travel most of the day for work email, GPS, radio etc....now AT&T has made my experience with them so bad that I'm seriously considering paying the cancelation fee for both my wife and my accounts and going with sprint. The crazy thing is, we have the roll over plan which we have thousands of unused minutes and my wife never uses her data! I pay $170 per month or $2,000+ per year to At&T for this bush league B$! Do you think I want to waste my valuable time searching for answers and a place for help? I'm sure if you have a customer who pays you $2k per year calls you and is unhappy with the business decision you made, I'm sure you will do everything in your power to make that customer happy. Well, AT&T's customer support team told me in a nut shell...Too Bad! We can't help you!!!
Wingrider, please remind your contacts at AT&T that it's hard to get new customers, they got lucky and stepped in ^$^%$ when they signed the iphone deal, now, the playing field is even.....if you make someone so upset that they leave your services, then they probably won't ever come back!

sorry, you have the same number of contacts I have at att, we have not done business with them since a POTS line was high technology.
What makes you think my "corporate goggles" are on? It changes nothing thepolciy is there, sorry on a personal account and a corporate acount I agree with what they are doing.
If they call support at the company, and it is a valid issue that is not in violation of their agreement with us, then we attempt to resolve the issue, if it is a agreement issue, then the agreement takes the priority. The company was started on that policy and has continued over the decades with that policy, no plans on changing it at all.

Yes, I have thought it through, and I’ll be glad if they terminate me with no etf. Actually that is my goal. I’ll be glad to take my 4 lines of services elsewhere, as other mentioned – if they don’t want my $260monthly bill I’m sure others will.
I’ll be glad to be on any tiered system on any other carriers because I KNOW WHAT I SIGNED UP FOR, and right when I signed up for the AT&T unlimited data plan that is what I expect. Pain and simple.
