We have the same problem. Sent letters to attorney general and FCC. The attorney general sent letter to ATT. The attorney general has been very deligent in getting ATT to respond. I have not heard from the FCC. I heard from an Executive Manager named Paula {personal content removed for safety} at ATT. After a couple of conversations she offered a solution to changing the "shortcuts" on my phone that were being "hit" accidentally and going out to the internet. If you have a Samsung (Evergreen?) phone here is the solution she offered:
Shortcuts
The Shortcuts option allows you to change the applications
assigned to your Navigation keys.
1. In Idle mode, select Menu âž” Settings âž” Phone âž”
Shortcuts.
2. Use the Navigation keys to select the Up, Down, Right, or
Left key.
3. Press the Options âž” Change. Highlight a new application
to assign to the previously selected key.
4. Press the Save soft key or the key to assign the new
application.
5. Follow the above steps for all four Navigation keys.
The idea here is to change the shortcut to something that would not go out to the internet, like "contacts" or "calculator". The only problem is you can only change the shortcuts on the navigation keys that are up, down, right, left. The center of the key cannot be changed. Which, of course, goes out to the internet. At least I was able to change my "right" navigation to something else that will not go out to the internet. So instead of two ways to accidentally hit a key, I only have one.
This is one solutions ATT offered me, other than turning off the function to access the internet, which, if done, I would not be able to send or receive pictures that is included in my plan.

picture and video messages are sent over the internet network. if u wanna send a pic/vid and you have nop data plan you are charged $2 for a mb.

No, if you have a texting plan, mms messages are covered by it

Same problem and it's on every bill. I had data, but took it off my plan. I have plenty of talking minutes and unlimited text. I don't want data, but can't turn off the access. I finally got tired of paying the extra $4 or $6 (we have 3 lines) so I didn't. I paid what i agreed to pay when and wrote a complaint. I received a response right away, but it was not a logical response. I can turn the data off, but in doing so it will reduce my texting ability ie: sending pictures which I pay for. So either way I pay for a service I can't use. I am paying for unlimited texting which includes the ability to send pictures. The rep suggested I either turn off the data which means I won't be able to send pictures or I sign up for a $4.99 service which will monitor my usage. Really? I don't need to monitor my usage. I have the plan set up exactly how I need and want the plan to be set up. I'm complaining about and excessive $2 data charge. She really thought suggesting a $4.99 addition to my plan was helpful? I have a Pantech Ease which I love. However, our problem is the voicemail "button" is right on top of the mobile email which is a data service. Even if you don't have fat thumbs it's hard NOT to hit the mobile email. As soon as we do, we try to disconnect immediately but are still charged. So I didn't pay the extra $2 fees last month. They ended up waiving $6, but still had some $1 charge added. Because of this $1 charge I didn't pay I am now being paid a $5 late fee. It should be such a difficult concept to AT & T. I'm not the only one with this problem. It's frustrating enough that I am considering switching plans in Nov.

I, too, had the same problem of $2 charges every month on my bill for internet usage, even though the AT&T argued amongst themselves whether or not I could use the internet. (I couldn't, I tried afterward). After canceling the $2 charge approximately 4 times, I was told that they would no longer cancel the $2 charges. Talk about a SCAM! AT&T Reps, IT IS A SCAM when a person is charged for internet but cannot access the internet.

We have the same issue. this thread describes it well. too bad ATT customer service does not know as much; we spent hours on the phone with a number of CSRs and getting conflicting and misnformation. we finally realized the situation. We want MSS/picture message unlimited as promised but no $2 charges.
we have, according to ATT, unpalatable choices:
a. pay an extra $10/month per line for a low-end data plan
b. block Internet access - that also blocks MMS
c. await each month's bill to see how many $2 charges appear.
ATT should either:
1. fix system to block internet and also allow MMS, or
2. automatically credit these bogus $2 charges, or
3. notify user and get consent (e.g., "continuing this request may incur additional charges. OK to proceed?")

The new thing now is that the $2 charge is because I accessed the AT&T App Center. Yeah right on a Samsung A137 flip phone.. Legalized theft!
