My contact started on 1/2/2007 and is set to expire on 1/2/2009, Friday. Customer care states I have to wait until 1/2/2009 to cancel the contract to avoid ETF. I recall cancelling an ATT contract several years back a few days before the actual date since everything is "pre-charged"/"pre-paid".
Can anyone confirm that I do have to wait until Friday (1/2/2009) to cancel without ETF?

Normally when ATT cancells an account they don't cancel the account the day you called in but they future date the cancellation till then end of you bill cycle. so you may have called in before when you were still within contract but your service was probably cancelled at the end of the bill cycle when you may of been outside of the contract. If this isn't the case then ATT cancelled your service early and waived the ETF as a courtesy. ATT is not required to do this courtesy everytime you cancel a line and is subject to pay an ETF if you don't wait the full 2 years of your service agreement.
