I have an iPhone 3GS and the home button is very worn out. It only works about 1/4 of the times I press it. Its extrememly slow and im not due for an upgrade until next year. If i take my phone to the AT&T store would they give me an iPhone 4 since it is the oldest model?

Simple answer is no, they won't just give you a phone.

Hmm.. well let's explore your options.
1) Since you have 1 year remaining on your contract, you may qualify for an early upgrade. This one is a bit costly, but you will not be paying the no commitment price for the iPhone 4S. You would pay $0.99 +$250 for a grand total of $250.99 before taxes.
2) You are also able to purchase the iPhone 4 for the No Commitment price of $450.99 before taxes.
3) You may wait until you are in month 20 of your 24 month commitment where you may qualify for a full upgrade and only pay $0.99 before taxes. Please note that if your service has been suspended multiple times for non payment, your upgrade date can be pushed back so make sure to check!

You could also add a line to your Family plan if you have one, and have less than 5 lines on it, and get a 4 for the $.99, then swap your phone number onto the new phone. Keep in mind your bill would increase by $9.99 per month.

The new line would have to stay active, but he could get a new micro-SIM for his number and use it in the 4. He could then drop the data plan from the new line as long as no smartphone is used on it.

No, the original contract still ends when it's suposed to. Only the new line is under contract for two years. Remember, the contract is on the voice line, not the phone.

Nope - the rep just puts a dummy IMEI on that line and it charges at $9.99. Customer can cancel that line of service without ETF when its contract ends.
