Hi I recently upgraded to a Samsung Galaxy S4 (like less than a week ago).
Let's say, I sell it or give it away to a person.
I know I commited to a 2 year contract so I have to pay for the data fee as long as I use a smartphone.
If I got another smartphone, let's say, iphone 4 and I just insert my micro sim into that iphone 4.
Would I incur any fee if I did this?

However, if your not happy with the galaxy S4, you could also just return it within the 14 day buyers remorse period and select another phone. Restocking fee may apply of course.
However.. If you still want to Go the route your asking about now, you can pay for an iPhone 4 and use it with your micro SIM yes. However, you data plan will need to be adjusted to the iPhone data plan.

Oh ok. The reason why I ask this is because I talked to one of the people working for att and he said, "come back after a month." That's different from you CAN'T sell it before 1 month has passed.
I called the att customer service, and this person who sounded inexperienced, said I have to wait 90 days.
Based on the two different answers I got for my question suggests that they are just trying to make me keep the phone for their benefits.
Can the person who I sold it to, unlock this phone?

No, they will not be able to unlock the iPhone because it was tied to your account. Only you can request the device to be unlocked.
