So phone orders received over a weekend aren't dated as of when they are entered, they are dated as of the following Monday? This just keeps getting better...
So customers who purchase a BB now get a data plan added right when they complete the order, correct? So doesn't the fact that her phone has no data plan necessarily prove that it was ordered prior to the change?

The fact that Saturday is not considered to be a business day is more than likely the reason you are seeing an order date of 9/7, as that would be the "next" business day, and the day when your order got processed.
If you're quoting "next" from some relevant document the reference is a little ambiguous, but regardless, the field is "order date" not "date processed". Are you suggesting it didn't get entered into their computers until Monday? Or perhaps that nothing can be "officially" purchased from AT&T on a weekend? If there is a document to support what you say I'd like to see it.
If what you say is true then effectively the grandfather date is Friday 9/5... one more thing wrong, what's next?

You are NOT "grandfathered" in to the no data plan, because your order DID NOT go through AT&T's system until SEP. 7'th, which was a Monday. Because Sep. 5th fell on a Saturday, AT&T's system did not pick that up until Monday the 7th.......... What is so hard to understand about this? Also, you should have been more forth coming with these dates in your original post, as it would have been more helpful in understanding the full picture here. Although you may have been able to place an order online, on a Saturday, it does not get picked up, and processed until the next business day, which would have been Monday, get it?

One thing I can't quite figure out here, are you defending the ethics/equity/fairness of this change, or are you merely opting out of discussing anything subjective like that? Did you already subscribe to the data plan by choice when the change happened? (I'm thinking those [effectively] unaffected by the change would be unlikely to find it offensive.)
To conclude, in an opinion that is not only mine, but is also widely held, it is unfair to tell a customer one thing and then do another. That is exactly the case here, and it is not fair. That the letter of their contract apparently permits it, does not make it right.
First, I am not defending anything, but rather, letting you know that AT&T did NOT break the T&C that were in the NEW contract that you agreed to when you purchased your Blackberry on 9/7/09............. Using words like "ploy", and "fraud", makes absolutely no sense to me.......... Furthermore, I fail to see how you wouldn't know that the data plan was added to your account within the 30 day period, when you had OLAM available to you, which one look there would have clued you into the fact that AT&T added the $30 data plan to your account.................... Now, I am sorry that you feel wronged by this new change, but you did have 30 days to back out of the deal, and "return" the device that triggered the data plan, and you still have options that are available to you now, that would eliminate the extra cost each month............. The bottom line here, is that you are not getting out of your contract without paying an ETF..................
Your assumptions are incorrect, still to this day the OLAM indicates no data plan selected, but my daughter received a text message stating that a data plan was required and that one would be forced down our throats if we didn't pick one. The page for her lins still has the "no plan" option. So no, I did not have any indication that would prompt me to return the phone, and the "options" involve writing-off what I have into the BBs.
As for whether or not I'll get out of the contract, are you implying that you are the one who makes those decisions? If so my attorney will be in touch. If not would you mind sparing me the definitive over-tone, when what you're saying can't possibly be definitive? You could say "according to stated policy..." or "no one I know of has successfully used..." or some other construct that does not infer you already know the outcome of my situation, because the fact is, you don't.

Again, the field is called "order date", as in I ordered it on that date, get it? They could process it on the second Tuesday of next week, but it matters not, when they processed it does NOT change what day I ORDERED it, what about that don't you understand?
If what you're saying is documented policy, show me the document, {Uncalled for comment edited - Please keep it courteous}

Perhaps you should take a minute to RE-read this forums guidelines for posting here. First of all, you took this thread way off topic, as it had absolutely nothing to do with a mandatory data plan. However, I tried to help you here anyway, and now you are being RUDE and NASTY to me, for which I do not appreciate. YOU are the one who placed the online order, therefore it is YOUR responsibility to understand all of the terms and conditions of such a transaction.......

catback wrote:Hi,Is this also true for an Iphone purchased through AT&T? Meaning, does the Iphone have to be used (along with the mandatory data plan) for the life of the contract period or can it be replaced by a non-smartphone at any time?Thanks.
You are free to switch to any device that you like throughout your contract term, however, if you are going to use a Blackberry, iPhone, or any other smartphone, you will be required to have the proper smartphone data plan on your account. If you want to switch to a NON-smartphone, during your 2 year contract, you are free to do that as well, and then you can have the data plan removed since you are no longer using a smartphone............ Hope this clears things up.
