That would be a big risk because per AT&T policy you are only grandfathered in on that single device. If he ever gets a replacement Blackberry even like his now it will remove the grandfather and add a data plan. And any new smartphone would remove the grandfather as well. Essentially if he never wants a data plan he is stuck with that one device so take good care of it. Only thing I know ATT grandfathered in on smartphones was unlimited data you could keep it when going from smartphone to smartphone but no data is not under the same rules.

Sorry no, do a search on the terms of service in the faqs, the ATT rep that told you that is wrong, this again is documented in the support section of this website. the plan may not have been added yet to your dad's phone, but if att's system recognizes it, it will be added.

And the change in terms would have probably been on Page 1 or 2 of your last September bill. Take a look at it.
Just in case you dont want to, I'll quote it here. This is how it shows up on the bill:
| Data Plan Requirement for Smartphones |
| An eligible data plan is required for Smartphones (including |
| iPhone, Blackberry & PDA devices) per AT&T's Wireless Rate |
| Plan Terms & Wireless Data Service Terms & Conditions at |
| www.att.com/planterms. If you begin using a Smartphone after |
| 9/05/09 without an eligible data plan, AT&T reserves the right to |
| add an eligible data plan to your account & bill you the proper |
| monthly fee. See www.att.com/smartphoneplans for more info. |
Thats right from the bill. So, you see, you were notified and you were given the link to the plan terms. Seriously, if you dont believe me look at your August - September bill. Its right there in black and white.

written like a true company man. all this is just <insert bad word here>... my son has a smart phone: it has a browser & pullout keyboard and a touchscreen...
it does NOT require a dataplan. it's a smart phone. but it's not an iPhone. so not ALL smartphones do it... just the popular ones because AT&T personifies everything that is wrong with this country: GREED.

Sounds like he has a enhanced QMD device - the samsung evergreen comes to mind, contrary to what you believe ALL smartphones require a data plan, not just the "popular ones". If it was a true smartphone and any of the carriers detected it as such a data plan would be added to bring into compliance with the contractual aggreement that you have with them, nothin you can do about it - you gave them permssion when you agreed to the TOS
As far as your comment on greed, remove att and substitute ever major carrier in the US, they ALL require data plans and the smaller ones are moving towards the requirement also.
No to debuke you falicy, I am not a "company man" - at least not ATT's.
