The early upgrade fee is a price you pay to buy a phone at a lower-than-full price before your full upgrade comes due. The ETF is a price you pay for getting out of your contract early. With the early upgrade fee, you end up with a new phone and a new contract. With the ETF, you just end your existing contract and don't get anything new.
For the purposes of eligibility for unlocking, I believe both are considered acceptable methods of terminating your contract. For the early upgrade, your old contract is considered satisfied as it has been replaced by the new contract, so you should be able to unlock your old phone.

I called Customer Service but they said i am not eligible. Should I call them again or directly go to an AT&A local store?
Do you have the iphone 5 on your account and have you completed the billing cycle, paid the bill that contains your etf and had the payment method cleared? If you have not paid the final billing cycle with all associated charges on the iphone 4s it will not become eligible until that has been done.

I've been wondering about this. I'm thinking they might make you wait until the 30 day return period for the iPhone 5 is over before letting you unlock your old phone. Otherwise, you could get it unocked, and then return the phone and go back to your old contract.

Hi, I'm eager to get the iPhone 5, but since I don't live in the US, I need it unlocked. I'm willing to pay full price ($650-$850). As far as I know, Apple isn't selling factory unlocked iPhone 5s in US yet, even though they are selling iPhone 4Ss factorry unlocked. Could someone please tell me on how I can get an unlocked iPhone 5?

Seems like you've answered your own question. Wait until Apple starts selling unlocked iPhones and then buy one. Have you looked at other countries? Maybe they are selling unlocked iPhone 5s now even though they aren't in the US yet.

Make sure you check out which model you buy. ATT's LTE model is not designed for use in other countries. read the requirements and documentation that is required to have att unlock the phone, fill in the form then wait. If you meet the requirements then it will be unlocked, if you don't or are unable to supplied the required documentation it will not be unlocked.

My son is letting me have his iPhone 4s, having replaced it with an iPhone 5. He has had the 4s for about 10 months, subscribing to a 2-year AT&T Internet service contract. He continues to use his existing contract for his 5 and paid full price for the 5. In this case, is the 4s considered to have satisfied all ATT's unlocking requirements as posted on ATT's Website, thereby eligible for unlocking?
Another question is do I need to get a new SIM card when I subscribe to ATT Internet service? Does ATT provide the new SIM card free of charge? I am currently a T-Mobile customer with my cell phone and not yet an ATT.

1) No, the device will still be under a 2 year commitment even if your son is using another device.
2) Are you trying to start service with AT&T from T-Mobile? If you are trying to start service with AT&T, then yes, they will help you get set up and port your number over if you desire to keep it. However, when going to the store, make sure you have the T-Mobile Account Number, wireless number (the one being ported) and the pass code, if you placed any on your account and you will be all set. Thanks, Evandaia, for your speedy response to my questions. I would appreciate it if you would also hellp clarify some follow-up questions below:
1. If as you say the iPhone 4s is still committed to my son's service contract, I would assume that it will be eligible for unlock at the end of that contract, i.e., about 14 months from now. Am I correct? (Note: The iPhone 4 has been on contract for about 10 months.)
2. When I sign up for new ATT service with the iPhone 4s, I do not need to sign a 2-year contract but instead can go on a month-to-month basis, the reason being I am providing my own iPhone. Am I correct?
3. My T-Mobile service is on a separate T-Mobile cell phone. It is not on the iPhone 4s Therefore, I believe I do not have to provide the ATT store the T-Mobile data as youn have suggested. Correct? .
4. I think my son has probaly left the original SIM card in the 4s and perhaps has erased all his data from the card. If this is so, do I still need a new SIM card when I start a new service with ATT?

I just want to point out that I recently (approximately a week ago) tried to get an iphone 3GS unlocked that was formerly AT&T from someone that I know did not steal the phone and was the original owner of this phone.
I did call customer service, who forwarded my request over to the unlock team (whatever that means). I received an email that requested I FAX INFORMATION to 214-782-644 with the following information provided:
1) "Device Unlock Code"
2) Your name
3) Account number
4) Mobile Number
5) Contact information - number & email address
6) Case Number
7) IMEI Number
8) Receipt showing price paid for device
After faxing in the information, I was denied the unlock not because it was reported stolen or that the account was terminated early or whatever, but because I DID NOT PURCHASE THE PHONE FROM AN UNAUTHORIZED SELLER.
I just want to make sure everyone knows that this is part of the requirement, even if it it is not STATED ON THE AT&T website that it is required to unlock a phone. In addition, I would like to see the AUTHORIZED SELLERS that AT&T approves listed on the website so I know what AT&T considers to be an authorized reseller of a phone that was originally purchased from them. Are they the only "authorized" reseller?
Although AT&T offers a phone unlock, they make it quite difficult for you to do so, even if you meet the requirements. No, I have not unlocked more than my alloted 5 phones per year for my account.

->That is correct, as soon as the contract had been fulfilled, the account holder (your son) will be able to unlock the iPhone for you.

-> That is also correct, you will be on a month to month basis, however make sure the representative sets up the account correctly!

You only have to provide that info IF you want to bring your number from T-Mobile to AT&T. Otherwise, you will have 2 phones activated.

-> Yes. They will provide them SIM card free of charge to you!

Hi,
I have a 3GS locked to att, My cousin bought me in 2009 , in full price ( 599 $) from Apple store.
The problem to get it unlocked is that I dont have the reciept of purchase to fax them .
I asked my cousin and he said he doesnt have it, what should I do ?
can he get it from Apple or ATT?

Hi I have a question, my Iphone was unlocked (SIM UNLOCKED) but the carrier still in AT&T what I need to do?, I restore my iphone many times and I did the restore to 5.1.1 and still equal. Only shows in the corner the legend "searching" or "No service" . Currently Im in Mexico, the carrier of my current provider shows but nothing happens. When I try to use some application of the SIM of my carrier appears : " This service is not available until you back to Mexico " . Tell me what I need to do?. Thanks

sounds like you had a jail broken phone that relocked when you upgraded, not much att can do unless you are the original owner or paid full price at an authorized retailer

actually yes it is stated
if you click on the start here button you are brought to a page that states this
In addition, AT&T will unlock an iPhone for: (i) an active and deployed member of the military who is a current AT&T customer in good standing and is able to provide AT&T with deployment verification; and (ii) a person who purchased the iPhone from an authorized location at the "no commitment" price and can provide proof of purchase.
When you click on the "I Agree" button you are sent to a form to fill in. When you select "Non-Cutomer" you get a drop down box that is titled "Purchase Location" the drop down box has 3 selections that are authorized
1. Apple Store
2. AT&T store
3. AT&T Authorized retailer
So unless you bought it from one of those three, it is not eligible, ebay, craigs list, and the such are not authorized retailers
So all your questions are answered in the form that you fill out, the same requirements are also in the knowledge base, so there really are no suggestions that can be made.
There are reports of third part companies that can unlocked the phone, but caveat emptor - they may not be reliable

Well, I can get a factory unlocked one from singapore, but theres more than a $100 difference between the ones in US and the ones in Singapore, I guess I'll hvae to wait. I wanna have it by Christmas, if Apple hasn't released the unlocked version by then, I'm gonna to have to resort to buying the At&t version. What exactly would I have to do in order to use it outside the US? Buy one without a contract?

You need to buy the unlocked version, not the no contract version. Even no contact phones can still be locked to a carrier.

You can buy it from Canada. Apple store canada will sell unlock version

I wish I knew someone from Canada. My friend in Singapore can buy it for me but the 16 GB there costs about the equivalent of $770 and the 32GB $880 (USD) and they are factory unlocked.
