Data Plan Necessary?

Alright I know this topic has been heavily beaten into the smartphone dicussion board but my question has never been answered completly. Alright this is my situation: My step mom is giving me her Samsung Galaxy S but the thing is I don't want to pay for data. IS there a way were I can slip my SIM card into the phone without being charged a data fee?

Yeah, I know what you want to do, but as soon as you slip your SIM card in, AT&T will be notified automatically and will tell you that you need a data plan. Talk to customer service 800-331-0500 and ask them about the least expensive plan there is for what you are going to use the phone for.

Is it an AT&T branded phone? If so, then the response above is correct. The system will read the IMEI number off the phone, and you will be shortly notified that a data plan will be added to your account. Might not happen right away, but it will happen.
If it is not an AT&T branded phone (such as the international version of the Galaxy S3), the IMEI number may not be in AT&T's database, and it may or may not read it as a smartphone. You might be able to get away without having a data plan, but there is no guarantee. And technically the terms of your contract say that a data plan is required if you are using a smartphone on the network.
